This Privacy Policy describes how GamerLink may collect and process personal information or personal data (“PI” or “Personal Information”), when you interact with GamerLink through the GamerLink website or app ("Services").

Who we are

The GamerLink experience is brought to you by GamerLink LLC (“we”, “our” and “us”). GamerLink LLC is a wholly-owned company in the Sony Interactive Entertainment group of companies. The specific Sony Interactive Entertainment company that is the Controller of the PI collected when you interact with GamerLink through our Services is set out below:

Personal Information That We Collect or Receive

Personal Information we collect about you

We collect and receive PI from and about you by different means as described below.

Personal Information You Provide to Us

We collect the PI that you directly provide to us, such as when you enter it on our website, or include it in an email that you send to us. This includes:

• Registration or the creation of a GamerLink Account (“Account”), where you provide PI such as contact information (e.g., name, email or physical address, country, or phone number); Account administration information (e.g., username and password); date of birth; profile information (e.g., profile photo and languages).
• Technical and customer support processes, where we may ask you to provide contact information and information about the issue you are contacting us about.
• Service features, where we may collect PI that you enter into features. For example, when you want to create a new group or party, you provide us with the content (which could contain PI) which we collect and then display. When you use features such as voice or text messaging, surveys, user-generated content, activity streams, or social media, we collect PI.
• Other business processes, where we may ask you to provide PI such as name, email address, online ID, and PI collected as free text. For example, if you participate in market research surveys, beta and other user testing research, competitions, promotions or events, or agree to receive marketing communications from us.

Please make sure that any PI you provide is accurate and current. If we contact you with any important information about your Account we will send it to you using the contact information you have provided (including Account security and privacy notices). You can check and update some of the PI you have provided to us at any time via Account Management.

Automatic Personal Information Collection

We automatically collect PI about your use of our Services. Each time you sign in to GamerLink and access our Services, we may automatically:

• Collect PI about your use of GamerLink and our Services.
• Log your activity on our GamerLink servers. For example, we may receive device and Account identifiers, such as your GamerLink online ID (your username) and account ID (the unique number associated with your Account).
• Collect details of the content, advertisements, and other information you request and receive from our servers (such as GamerLink content, content generated by other users, parties or friends lists) and how you interact with it; messages you send and receive, including their content.

Cookies and Similar Technologies

If you interact with our Services, marketing communications, or advertising (on our or third party websites and services), we may automatically log your activity through the use of cookies (which are small text files stored on your computer) or similar technologies such as web beacons or tracking pixels. These technologies allow us to recognise you and remember your visit and preferences. We may use cookies and similar technologies to provide our Services, including to monitor, secure and maintain our Services, detect and prevent fraud, analyze and improve our Services, and for advertising purposes.

Personal Information We Receive from Third Parties

We may receive PI from third party sources and combine it with PI we already collect from you. We may also collect PI from third party publicly-available services, including those that share user generated content. We will handle the PI in accordance with this Privacy Policy. PI we receive from third party sources includes:

• PI from other people, for example if someone engages with you or your content on our Services, submits a report of inappropriate behaviour or otherwise provides PI about you.
• PI from third parties who provide services to us. For example, we may receive PI from anti-fraud service providers to help us identify fraudulent behaviour, details of suspected unlawful or malicious activity from law enforcement, or information about your activity on third party services you engage with from those services or from marketing or measurement service providers

Personal Information Use

How we use the Personal Information we Collect or Receive

This section explains how we use the PI we collect or receive about you. We will only use your PI where we have a lawful basis to do so. The lawful bases we rely on depend on your account creation country, the type of relationship we have with you and how we interact with you. These lawful bases include the following:

• Contract – to provide our products and services to you and fulfil our contractual relationship with you.
• Legitimate Interests – to fulfil our legitimate interests, or those of a third party in conducting and managing our business and our relationship with you as described in this Privacy Policy. For example, we rely on legitimate interest to (a) detect and prevent fraud, the unauthorised use of our Services, and other harmful or illegal activity, including by reviewing reports submitted by other GamerLink users, (b) improve our products and services, including by performing analytics and business reporting in relation to how you use our Services and any issues you may encounter, and (c) share information with other Sony Group Corporation companies where necessary to support the security of our Services.
• Legal obligation – to meet our legal obligations under applicable law, including to comply with financial reporting requirements.
• Consent – where you have provided us consent to process your PI for a specific purpose, including to send marketing messages to you. When we process your PI on the basis of consent, you can withdraw your consent at any time. See the Choices section of this Privacy Policy for more information.

We may combine and process the PI we have collected about you for the purposes explained in this Privacy Policy.

Services

We use your PI to operate our Services. This includes:

• To provide and operate the Services: for example, we will use your PI to enable you to sign in to our Services, link your accounts, make purchases, and interact with others online.
• To personalize the Services: for example, we may use your IP address to display content relevant to your location or use voice or text data to deliver accessibility settings.
• To secure and protect you and the Services: for example, we may verify that the PI you have provided is accurate or request additional PI (such as identity documentation or age information) to verify your age or identity, and we will process PI to detect and prevent fraudulent activity and transactions.
• To develop, understand, improve and enhance our Services, your experience, and to develop and enhance technologies: for example, we may use PI to develop and optimise user interfaces or new technologies.

In addition, we may transform personal information into information that does not identify you individually (such as de-identified or aggregated information) to use for business, operational, analytical or other purposes.

Moderation and Safety

While we strive to ensure the security of our Services and we maintain robust systems and processes, please be aware that it is not possible to continuously monitor every aspect of our Services. Under our Terms of Service, you and our other users are required to comply with our Rules, available here: Rules and Regulations - GamerLink. As such, we may monitor, review and record your online activities, communications (including messages, images, videos and voice communications) and content throughout our Services for the purposes of assessing whether these activities, communications, and content comply with our Terms of Service, our Rules, and any other terms or rules applicable to your use of our Services (together, "Terms”) or applicable law. We will also review reports made by you and other users for breaches of the Terms.

To do so, we may use technology that automatically detects online activities, communications, and content that may breach the Terms or applicable law (“Monitoring Technology”). We may also use the PI we collect (as described in this section and elsewhere in this Privacy Policy) to improve and develop Monitoring Technology. We may remove or delete any of your communications and content that breach the Terms or applicable law, take action on your account or device as set out in the Terms, and share these communications or content in accordance with the Government & Authorities section of this Privacy Policy.

Marketing and Advertising

Subject to your Account settings, we may personalise our marketing communications and advertisements (including those displayed on our and third-party websites and services) based on the PI we have collected about you. You may notice this personalisation on the GamerLink website or app, or in marketing communications. We may also use this data to measure the performance of our websites and advertisements and marketing campaigns, to understand how they can be improved and to pay or be paid for the placing of advertisements.

Legal and Compliance

We may use the PI we collect for auditing, compliance and legal purposes (for example, protecting the rights and property of Sony, its partners and customers, or preparing assessments and reports required by applicable law).

Security

In order to help protect Sony Interactive Entertainment, you and others, we may use the PI we collect and receive for security purposes, including to:

• Identify fraudulent activities and transactions.
• Prevent abuse of and investigate and/or prosecute any potential threat to or misuse of our Services.
• Protect your account from unauthorised access (for example by preventing access if an attempt is made to log-in from a new location).

Personal Information Sharing and Transfers

Who we share Personal Information with

This section explains how we may share the PI we collect with third parties that provide services to us. We do not and will not accept money in exchange for sharing PI. We may share your PI with the following recipients and for the following purposes.

Sony Interactive Entertainment Group of Companies

We are a wholly-owned company in the Sony Interactive Entertainment group of companies. We may share your data with other entities in the Sony Interactive Entertainment group of companies, to provide you with content, products, or services, including games, videos, music, software and software applications; for community administration or development; to support various business and security processes; research and development; and so that other Sony Interactive Entertainment group companies may contact you about products, services or other offerings that may be of interest to you.

Service Providers & Other Partners

We share PI with our service providers, who are persons or companies that provide services which may include handling PI for any of the purposes described in this Privacy Policy. Service providers are required to adhere to confidentiality and security requirements. We may share PI with the following service providers and partners:

• Other service, application or website providers, for operational purposes, or for additional purposes, with your permission (such as when you link your Account to a third party account).
• Security and fraud partners, to support the security of our Services, fraud prevention, the detection and removal of harmful content and users who share harmful content, and to protect PI.
• Business transfer partners, in connection with the negotiation and sale of the applicable business, a portion of the business, or certain stock and/or assets, or a corporate merger, consolidation, restructuring, or other corporate change including, during the course of any due diligence process.

Other Users

You are responsible for any content you share using posts, chat, and messaging features. This content will be accessible to other users who can then share that PI further. We recommend you consider carefully what you share and with whom you share your PI.

When you create an Account, certain PI will form part of your public profile and we will make it accessible to all Accounts on GamerLink. This PI includes:

• Your GamerLink online ID;
• Your profile information including username, avatar, bio, recent activity;
• Content you have shared.

We may index and use content which you have shared publicly. We may act on any harmful content you share, including by removing and reporting the content, and suspending your access to the Services.

Government & Authorities

We may share your PI with police, government, and other authorities if we believe that it is reasonably necessary to comply with a law, regulation, or legal process, to detect, protect and enforce the safety of any person, their property or their rights, to address fraud and security and report criminal activity.

Personal Information Handling

Children’s Personal Information

GamerLink is only for users aged 13+. If you are below this age in your country, GamerLink is not for you. If we discover that a child under the age of 13 (or as otherwise under the relevant age for parental consent set out in the laws of their country) has created an Account, we will terminate that account and delete account information except for information we are required by law to retain to demonstrate our compliance.

International Transfers

Our Services operate in the United States, United Kingdom, Japan, and other countries/areas/regions, which means that we collect, process and store your PI globally and, as such, courts, law enforcement, and other authorities in these countries may, in certain circumstances, be entitled to access your PI. Privacy laws in some of these countries may not offer the same level of protection as those in the country you reside or are a citizen. We ensure there are adequate safeguards in place when transferring your PI outside your country including by entering into contracts with the recipients that incorporate the European Commission Standard Contractual Clauses or other relevant transfer mechanism and require that the transfer only occurs where permitted by applicable law. By using our Services, you acknowledge the transfer, processing, and storage of your PI to or in these countries.

Security

We maintain appropriate technical and organisational security measures that conform to industry standards to help protect your PI against unauthorised or accidental disclosure, access, misuse, loss, or alteration. Although we strive to protect your PI, we cannot ensure or warrant the security of such PI. We recommend you take steps to protect your PI, including:

• Keep any passwords and passcodes for your devices and accounts safe and do not disclose them to anyone else. Avoid using the same password for multiple accounts.
• Contact GamerLink Support immediately if you become aware of any unauthorised use of your Account or other security incidents.

Please contact GamerLink Support if you need any assistance in restricting access to your devices or accounts.

Retention

We retain PI about you as long as it is necessary for us to fulfil the purposes outlined in this Privacy Policy. In addition, we retain your PI as long as is permitted or required to, among other things, comply with our legal obligations, resolve disputes, and enforce agreements. Where required by applicable law, we will delete your PI when it is no longer necessary. Even if we delete your PI from active databases, your PI may remain on backup or archival media as well as other information systems.

Subject to applicable legal requirements, we may revise this Privacy Policy at any time. By continuing to access or use our Services after those changes become effective, you acknowledge and accept that PI will be handled in accordance with the revised Privacy Policy.
